Agreement Overview

These Terms of Service ("Terms") govern your use of MailFlowMonitoring.com ("Service"), operated by DuoCircle LLC ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

Service Description

MailFlowMonitoring provides round-trip SMTP email monitoring services that help you track the health and performance of your email infrastructure. The Service sends test emails to your specified addresses and monitors responses to detect delivery issues.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service to send spam or malicious content
• Reverse engineer or attempt to extract source code
• Use the Service to develop a competing product
• Submit sensitive personal data (health, financial, etc.) through monitoring tests

Service Availability

We strive to provide reliable service and aim for 99.9% uptime. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice when possible)
• Emergency repairs or updates
• Factors beyond our reasonable control

Data Protection

We implement security measures to protect your data:

• Encryption in transit (TLS/SSL) and at rest (AES-256)
• Role-based access controls
• Regular security audits
• SOC 2 Type II compliant infrastructure

We will not disclose your data to third parties except as required to provide the Service, comply with law, or as described in our Privacy Policy.

Intellectual Property

The Service, including its design, features, and content, is owned by DuoCircle LLC and protected by intellectual property laws. You retain ownership of any data you submit to the Service.

Payment Terms

For paid plans:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We may change pricing with 30 days notice
• Failure to pay may result in service suspension

Service Warranty

We warrant that the Service will perform materially as described in our documentation. If the Service fails to meet this warranty and we cannot remedy the issue within 30 days of notice, you may terminate your account and receive a refund for any unused prepaid fees.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is limited to amounts paid by you in the preceding 12 months
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for loss of data, profits, or business opportunities

These limitations do not apply to liability for fraud, gross negligence, or willful misconduct.

Indemnification

You agree to indemnify and hold harmless DuoCircle LLC from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

Termination

Either party may terminate the agreement:

• With 30 days written notice for any reason
• Immediately if the other party breaches material terms

Upon termination, your right to use the Service ends. We will delete your data within 60 days of your request.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Diego County, California.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
